Overview

14788001 Canada Inc., doing business as Solutions de paiement Tap2Pay (“Tap2Pay”, “we”, “us”, or “our”) provides merchant payment solutions, software, and related services. By using our website or services or by opting into our SMS messages you agree to these Terms.

1. Acceptance

By using our Services or opting in to receive SMS from us you accept and agree to these Terms.

2. Eligibility

You must be 18 years of age or older to use this SMS service. By providing your mobile phone number and opting in to receive SMS messages from Tap2Pay (14788001 Canada Inc.), you represent and warrant that you are at least 18 years of age or have the permission of a parent or legal guardian where permitted by applicable law. If you do not meet this requirement, you must not subscribe to or use our SMS messaging services.

3. Legal & Registered Identity

This website and services are provided by 14788001 Canada Inc. doing business as Solutions de paiement Tap2Pay (Tap2Pay).

4. Program Name

Tap2Pay Messaging Program (merchant notifications, terminal status updates, and promotional offers where you have provided explicit consent).

5. Program Description

Tap2Pay sends SMS for: (a) transactional/operational notifications about merchant terminals, payments, and account activity; (b) customer support and status updates; and (c) promotional messages only if you have explicitly opted in. Message frequency varies; promotional messaging frequency will be disclosed at opt-in and generally will not exceed 4 messages per month unless you consent otherwise.

6. How to Opt In & Opt Out

• Opt-in: You opt in via our website form, paper form, QR code, or other specified opt-in method where you explicitly check the consent box for marketing and/or non-marketing messages. A confirmation message is sent after opt-in.
• Opt-out / Cancellation procedure (required): Text STOP to the originating number to unsubscribe. We will send a confirmation and stop non-exempt messages. To receive help text HELP or contact admin@tap2pay.ca.

7. Carrier Liability Disclaimer

Carriers are not liable for delayed or undelivered messages. Tap2Pay is not responsible for carrier delivery issues.

8. Message Frequency & Rates

Message and data rates may apply for messages sent to you and from you. Message frequency varies. Contact your wireless provider for plan or rate information.

9. Customer Care & Support

For messaging support: email admin@tap2pay.ca or call +1 800-455-9090. You can reply HELP to any Tap2Pay SMS for assistance.

10. Privacy Policy

11. Prohibited Content & Suspension

You must not use the Service to send prohibited content (fraudulent offers, hate speech, illegal goods/services, unsolicited lead lists that violate carrier rules). Tap2Pay may suspend or terminate accounts violating these Terms or carrier rules.

12. Intellectual Property

Tap2Pay owns or is licensed to use all intellectual property in the Service. You may not reproduce or create derivative works without permission.

13. Limitation of Liability

To the fullest extent permitted by law, Tap2Pay’s liability is limited to direct damages not exceeding fees paid to Tap2Pay in the prior six (6) months. Tap2Pay is not liable for indirect, incidental, or consequential damages.

14. Changes to Terms

We may update these Terms. We will notify you and post updated Terms on the website; continued use after notice constitutes acceptance.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Canada and the province of Quebec. Any dispute will be brought in the courts located in the judicial district of Laval, Quebec.

16. Language (Quebec requirement)

Les parties ont expressément demandé que les présentes conditions et tous les documents s’y rattachant soient rédigés en anglais. The parties have expressly requested that these Terms and all related documents be drawn up in English.
